VPSPhantom provides GPU server rental services for computational workloads including but not limited to machine learning, artificial intelligence training, rendering, and other GPU-intensive tasks.

• Server Access: Upon successful payment, you will receive access credentials to your allocated GPU server resources.
• Resource Allocation: Server specifications, including GPU type, memory, storage, and bandwidth, are as described in your selected plan.
• Availability: We strive to maintain 99.9% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be communicated in advance when possible.
• Support: Technical support is provided via our ticketing system and Discord community.

All payments for VPSPhantom services are processed in USDT (Tether) cryptocurrency.

• Currency: Payments are accepted exclusively in USDT on supported blockchain networks as specified during checkout.
• Pricing: All prices are displayed in USD equivalent. The USDT amount required may vary based on network fees.
• Billing Cycle: Services are billed according to the selected plan (hourly, daily, weekly, or monthly). Recurring charges will be processed automatically unless canceled.
• Payment Confirmation: Service activation occurs after blockchain confirmation of your payment. Confirmation times vary by network.
• Late Payments: Failure to maintain sufficient balance may result in service suspension or termination.

You agree to use our Services only for lawful purposes and in accordance with these Terms. You are prohibited from:

• Illegal Activities: Using our Services for any illegal purpose, including but not limited to cryptocurrency mining for illegal schemes, distribution of malware, or any activity that violates applicable laws.
• Network Abuse: Engaging in activities that disrupt, damage, or impair our network or other users' services, including DDoS attacks, port scanning, or unauthorized access attempts.
• Resource Abuse: Attempting to exceed your allocated resources, bypassing usage limits, or interfering with resource allocation systems.
• Content Violations: Hosting, transmitting, or processing content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
• Unauthorized Access: Attempting to gain unauthorized access to other users' servers, our systems, or third-party systems.

Violation of this Acceptable Use Policy may result in immediate termination of services without refund.

Due to the nature of our services and cryptocurrency payment processing:

• Service Issues: If our Services fail to meet the specifications described in your plan due to our fault, you may be eligible for a prorated credit or refund at our discretion.
• Unused Time: Refunds for unused service time are generally not provided. You may request account credit for future use.
• Cancellation: You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period.
• Disputes: All refund requests must be submitted within 7 days of the billing date. Contact our support team with your transaction details.
• Processing: Approved refunds will be processed to your original USDT wallet address within 5-10 business days.

To the maximum extent permitted by applicable law:

• No Warranty: Our Services are provided "as is" and "as available" without warranties of any kind, either express or implied.
• Service Interruptions: We are not liable for any damages arising from service interruptions, data loss, or system failures, whether caused by hardware failure, software bugs, network issues, or force majeure events.
• Indirect Damages: We shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities.
• Liability Cap: Our total liability for any claims arising from these Terms or your use of our Services shall not exceed the amount you paid for Services in the three (3) months preceding the claim.
• Your Responsibility: You are solely responsible for maintaining backups of your data and for any activities conducted through your account.

You are responsible for maintaining the security of your account:

• Credentials: Keep your login credentials and server access keys confidential. Do not share them with unauthorized parties.
• Two-Factor Authentication: We strongly recommend enabling 2FA on your account for enhanced security.
• Unauthorized Access: Notify us immediately if you suspect unauthorized access to your account.
• Account Activity: You are responsible for all activities that occur under your account.

Either party may terminate the service relationship:

• By You: You may terminate your account at any time through your account settings or by contacting support.
• By Us: We may suspend or terminate your account immediately if you violate these Terms, fail to pay for Services, or engage in activities that harm our platform or other users.
• Effect of Termination: Upon termination, your access to Services will cease, and any data stored on our servers may be deleted after a grace period of 7 days.
• Survival: Sections relating to limitation of liability, indemnification, and governing law shall survive termination.

We reserve the right to modify these Terms at any time:

• Notice: We will notify you of material changes via email or through our platform at least 30 days before they take effect.
• Continued Use: Your continued use of our Services after the effective date of any modifications constitutes acceptance of the updated Terms.
• Disagreement: If you do not agree with the modified Terms, you must stop using our Services before the changes take effect.
